Goal

The goal of the course is to familiarise students with the institutes and procedures related to the employment process and the conclusion of employment contracts; the regulation of wages, other rewards and compensation; the modalities of working time regulation; occupational health and safety, privacy protection and issues of monitoring, video surveillance of employees, and electronic mail tracking; the prohibition of business competition between the employee and the employer; the prohibition of discrimination and the problems of psychological harassment in the workplace; terminations; and the role of the works council. No less important, the course will provide a summary overview of the open issues regarding the free movement of workers within the EU, as well as the posting of workers within the framework of the freedom to provide services.

  1. Introduction to human resource management law (relevant institutes, different sources of labour law and their correlation); labour law and human resource management law.
  2. Prohibition of discrimination at work and in employment, and the prohibition of psychological harassment in the workplace. Video surveillance and monitoring of employees' electronic communication. Protection of employee privacy.
  3. Establishing the employment relationship (types of contracts, examples of good practice, dilemmas regarding implementation and interpretation).
  4. Wages, rewards, and other compensation.
  5. Prohibition of market competition between the employee and the employer.
  6. Regulation of working hours.
  7. Termination of the employment contract (special focus on dismissals/redundancy, agreement on termination of the employment contract, and judicial termination of the contract).
  8. Peaceful forms of resolving (individual) disputes.
  9. The role of the workers' council.
  10. Occupational Health and Safety.
  11. Free movement of workers in the EU.
  12. Posting of workers within the framework of the freedom to provide services.

After passing the examination in the course Law of Human Resource Management, the student will be able to:

  1. Independently define the relevant labour law institutes that are important for the field of human resources management.
  2. Independently define research problems in the areas of employment and remuneration of workers, and practically and partially apply the appropriate legal rules to: the establishment of an employment relationship, distinguishing between an employment contract and a management contract, regulation of working time, protection of workers' privacy, prohibition of discrimination against workers and prevention of psychological harassment (mobbing) in the workplace, prohibition of market competition by a worker with their employer, termination of the employment contract, and other related areas (in accordance with the course content and aims).
  3. In-depth critically analyse, evaluate, and synthesise professional and scientific literature in the subject area, with a special emphasis on the relevant institutes, their practical implementation, and (judicial) interpretation.
  4. Recognise, interpret, and apply appropriate legal rules to specific cases in the field of law of human resource management.
